
Availability. The offer of any property is subject to the property being available on receipt of deposit from the party leader. The party leader must be at least 18 years of age at the time of booking and authorised to make the booking on the basis of these Booking Conditions by all other members of the holiday party.
Deposit and Payment. A deposit of £50 per person per week is required when booking more than 8 weeks in advance of your arrival date. This amount will be credited against your account. On receipt of your deposit, a booking confirmation from Newquay-Apartments will be sent to you, the details must be checked carefully. If anything is incorrect, you should tell us immediately.
The confirmation will show booking details and the total balance due. Payment for the total balance must be received by Newquay-Apartments no less than 8 weeks before the date your holiday commences. If you book less than 8 weeks before your arrival date, full payment of your holiday is due immediately. For properties booked less than 4 weeks before your arrival date your booking must be paid for in full by debit or credit card, or by bank transfer, at the time of booking.
If paying more that 4 weeks before your arrival date, payment may be made by cheque (made payable to "Esplanade Hotel") or by credit/debit card. The Party Leader must handle all aspects of the booking and make one single payment. If we are required to debit more than one credit card in respect of a group booking, we charge an administration fee of £25 per booking. Should the deposit and/or full payment not be paid by the due dates, we reserve the right to cancel the booking and levy cancellation charges as laid out below. Please note that payments made via credit card have a surcharge of 2% on the total amount of the booking.
Once we have sent your Confirmation and Invoice, no further reminder will be sent unless you specifically ask us to send you one. You can request that our reservation team debit the balance automatically from your credit card on the due date.
Any charges outstanding following the holiday will be automatically deducted from your credit/debit card.
Cancellations: The guest deposit is non-refundable however in certain situations the deposit may be transferred to another booking. All cancellations must be notified to us in writing by the person who paid the deposit. The deposit will be forfeited in all cases and, depending when notification is sent to us, the following charges (expressed as a percentage of the total holiday cost) will be made:

If no written notice of cancellation is received and the guests do not arrive, cancellation will be deemed to have been effected on the day of departure. We reserve the right to re-sell any part of a cancelled holiday and this does not affect our right to levy cancellation fees. Forfeited deposits will be held by Newquay-Apartments to cover administration and marketing costs.
Variations:
It is most unlikely that we will have to make changes to your holiday but, having made arrangements many weeks / months in advance of your travelling, we reserve the right to do so. If we do have to alter your holiday in any way, we will inform you of the alteration as soon as possible. In the case of a major alteration we will offer you the choice of a holiday of at least comparable standard or a full refund.
Should you wish to make any alteration to your booking after it has been confirmed by us, we will comply with your request where possible. If you increase the value of the booking we will not charge an amendment fee; otherwise we may charge a fee of £25 per person per amendment.
Property:
Newquay-Apartments aims to ensure that the information provided by Owners is accurate and up-to-date. Occasionally, problems mean that some facilities or services become unavailable or subject to restriction. If this happens, the Company will tell the party leader as soon as reasonably practical after the Company becomes aware of the situation. As Newquay-Apartments acts only as agent for the property owner Newquay-Apartments cannot accept responsibility for any inaccurate, incomplete or misleading information about any property or its facilities and/or services except in the case of the negligence of Newquay-Apartments. We will, however, aim to notify you of any changes to or inaccuracies in any information contained in our website as soon as reasonably practical after we become aware of the change or inaccuracy.
Liability:
If you suffer personal injury or death from any activity which is not part of your holiday booked with us but occurs during the holiday, we will not be liable for any compensation. The Property Owner and Newquay-Apartments shall have no liability for any death or personal injury. You must take all necessary steps to safeguard your personal property. No liability is accepted by the owner of Newquay Apartments in respect of damage to, or loss of, such personal property. Further, Newquay-Apartments cannot accept any liability for any shortcomings or defects within the property as all properties are within the sole control of the property owner.
The proprietors disclaim responsibility for any injury or damage to guests’ property or to their person or to their children or their pets by fire, theft, water or any third party or by any means whatsoever whilst they are on the site. This includes acts of God, civil strife, industrial action, natural disasters, war, animals and insects.
Arrivals and Departures:
Keys can be collected from 3.30pm on day of arrival, and returned by 10.00am on the departure day.
Dogs:
Dogs are only allowed in a limited number of properties as per the owner’s guidelines. A charge of £20.00 per dog per week is made.
If you take a pet with you, it is not allowed on beds or furniture. Please note damage terms below.
Pets should not be left unattended in the property, and dogs should be kept on a lead within the boundaries of a property including the garden. Registered guide and support dogs belonging to those with visual and hearing impairments are allowed in all properties featured on this website even where the property description states that pets are not allowed.
Customers with allergies should be aware that we cannot guarantee that a registered guide and/or support dog has not stayed in their chosen property nor can we accept any liability for any suffering which may occur as a result of such animals having been present.
V.A.T.
V.A.T. is included in all prices and is calculated at the present rate of 17.5%, and is subject to any change.
Bathing Towels. Guests are requested to bring their own towels for the beach or swimming.
Allowances. No allowances can be made for accommodation not being occupied for the full period of booking.
Special Offers. Special offers cannot be used in conjunction with any other offer, and if conditions are not met then the standard tariff will apply.
Behaviour. Behaviour of guests and their visitors should not be excessive or rowdy, and must not cause inconvenience to nearby residences. Please inform us before arrival if you are travelling in a single-sex group. We reserve the right to refuse unauthorised groups and you will be required to provide a ‘damage deposit’ at check-in.
You also must not allow more people than the brochure states to occupy the property, neither can you significantly change the composition of your party during your occupation of the property.
If you do any of these things, the Owner can refuse to hand over the property to you, or can repossess it. If the Owner does so, this will be treated as a cancellation by you. In these situations no refund of any monies you have paid in respect of your booking will be made and neither the Owner nor the Company will have any liability to you as a result of this situation arising (including for example any costs or expenses you incur due to not being able to occupy the property, such as your incurring the cost of securing an alternative property/ accommodation or the payment of any compensation to you). The Owner or the Company will also not be obliged to find any alternative accommodation for you.
Damages:
You are responsible to the Owner for the actual costs of any breakage or damage in or to the property - along with any additional costs that may result - which are caused by you and/or any members of your party, including animals.
This includes damage to hotel buildings, fixtures and fittings - along with any additional costs that may result - which are caused by you and/or any members of your party.
Some properties require a security deposit. Where appropriate, guests will be advised at the time of booking and you will be required to pay the deposit on arrival. The deposit will be refunded on the departure day less any costs for breakages and damage.
We trust that you leave the accommodation as you found it on arrival, in a CLEAN and TIDY condition and that all breakages have been paid for. Vacuum cleaners are available within each property and a cleaning charge of £45 will be deducted from your credit/debit card should the accommodation be left in a poor condition. Upon request we are happy to inspect your accommodation prior to your departure.
Access:
You must allow the Owner and any representative of the Owner (including workmen) access to the property at any reasonable time during your occupation of the property (except in cases of emergency or where a problem needs remedying quickly and you cannot be contacted in time - in these situations the Owner is entitled to enter the property at any time without giving you prior notice).
Other:
The management reserve the right to introduce additional conditions or to waive any particular conditions in individual cases or to amend or vary the terms and conditions.
